Terms & Conditions

This Handyman Services Agreement (“Agreement”) outlines the terms and conditions between Wixfix Pty Ltd (“Wixfix”) and the customer (“Customer”) for provision of handyman services.

Definitions

For purposes of this Agreement:

“Authorized Contractor” refers to licensed contractors engaged by Wixfix to perform services.

“Customer”, “You”, “Your” refers to the party requesting and receiving services from Wixfix.

“Estimate” refers to a cost projection prepared by Wixfix based on project details provided by the Customer.

Estimates are not binding quotes due to variable nature of work.

“Handyman” or “Technician” refers to employees of Wixfix who perform hands-on services.

“Project Manager” refers to a Wixfix representative responsible for overseeing a project.

“Project” refers to the specific scope of work being completed by Wixfix for the Customer.

Service Description

Wixfix is an insured handyman bussiness operating in Queensland, Australia.

Our mobile workshops allow technicians to efficiently provide services in various locations and project sites.

Wixfix agrees to provide the services specified in the Estimate and any subsequent written modifications or change orders.

Estimates and Consultations

For complex projects, the Customer will provide detailed work lists, photos and other documentation to allow preparation of an Estimate by Wixfix.

A Project Manager may conduct an initial on-site consultation to fully assess the scope of work, for a $60 fee credited towards any project over $5,000.

Estimates represent projected costs and timeframes but are not binding quotes, as underlying assumptions and conditions may change during performance of services.

By approving an Estimate, the Customer authorizes Wixfix to commence services and pre-authorizes payment of Estimate amounts by credit card.

Additional Requests and Changes

The Customer may request additional work beyond the approved Estimate (“Add-Ons”), but Add-Ons will only be performed if the Technician has capacity and ability within a 15 minute timeframe.

Wixfix reserves right to decline unauthorized changes to the pre-approved scope of work that were not included in the original Estimate.

Estimates will be adjusted for any Add-Ons over $375.

Deposit Requirements

Estimates between $500-10,000 require a 50% deposit in advance.

Estimates over $10,000 require 33% deposits initially and again at the halfway point, with balance due upon completion.

These deposit amounts are non-refundable unless services are not fully performed as agreed.

Appointment Cancellations and Rescheduling

The Customer may cancel or reschedule appointments without penalty by providing at least 24 hours’ advance notice.

Cancellations or rescheduling with less than 24 hours’ notice will incur minimum cancellation fees equal to one technician hour at regular rates, plus materials costs if applicable.

These fees will be charged to the credit card on file.

Confirmation of Appointments

The Customer must confirm all scheduled appointments via email link provided by Wixfix within 24 hours, or the appointment will not be deemed canceled under the cancellation policy.

Failure to confirm is not considered cancellation.

Materials and Labor

Unless other arrangements are agreed in writing, the Customer is responsible for providing all necessary finishing materials to meet their specifications and satisfaction.

Alternatively, the Customer may request Wixfix to source and supply materials on their behalf for a $60 fee plus actual material costs.

Specialty or custom materials require additional hourly sourcing fees be paid by the Customer.

Off-Hours Services

As designated by Wixfix, services performed outside standard business hours incur premium rates ranging from 1.25x to 2x regular hourly rates, depending on time and day of the week.

These premium rates accounts for added costs to Wixfix of performing services outside standard business hours.

Service Call Charges

A $50 service call fee applies to all jobs within Wixfix’s local service area, to cover technician transportation costs.

Additional service charges apply for jobs requiring multiple service visits.

Minimum Service Charges

All jobs requiring less than one hour to complete will incur a minimum one hour service charge based on the assigned technician’s hourly rate.

Materials costs are additional.

Sign-Off on Completed Work

The Customer or their authorized on-site representative must electronically sign-off to confirm all work is completed to their satisfaction.

If someone other than the person who signed the original Estimate signs off, the Customer forfeits any later right to assert work was improper or incomplete.

Sign-off confirms the invoice amount is undisputed and due.

Payment Terms

Payment in full is due within 30 days of invoice issuance unless other arrangements are agreed in writing.

Late fees and collection costs including reasonable attorneys’ fees may be charged on overdue balances.

10% retention for pending warranty calls is permitted.

Estimates must still be paid even if warranty calls are later performed for no charge.

Credit card payments on file may be charged if invoices are unpaid after notice.

Warranty

Wixfix provides a standard 90-day warranty on workmanship and materials for repairs, and two years for new installations or major remodels, excepting damage due to external causes such as weather, accidents or alterations by others.

Warranty calls can be scheduled by contacting Wixfix within the applicable warranty period.

Pre-Work Site Preparations

The Customer must clear all belongings, furnishings and other obstacles from project work areas for safety and efficiency.

Wixfix is not responsible for unattended property remaining on site.

Additional fees may apply if site not properly prepared on arrival.

Intellectual Property

Any intellectual property owned or created by Wixfix, including trade secrets, copyrights, designs, software and business processes, remains Wixfix’s sole property.

Customer information provided is confidential except where disclosure is required by law or legal process.

Client Information Requirements

The Customer must provide complete and accurate contact details and promptly update any changes.

Failure to do so may result in suspension of services.

Limitation of Liability

In no event shall Wixfix’s liability to the Customer exceed amounts paid under this Agreement.

Wixfix is not liable for indirect, consequential or special damages, and liability is further limited by applicable law.

Indemnification

The Customer shall indemnify and hold harmless Wixfix from all third party claims and associated losses or liabilities, excepting claims due to Wixfix’s intentional misconduct.

Changes to Approved Estimates

Any changes to the approved scope of work require a written change order signed by both parties specifying adjustments to estimates, timelines or specifications.

Verbal or implied changes are not binding.

Governing Law and Venue

This Agreement shall be governed by Queensland law and resolved in courts within Queensland, Australia without regard to conflict of law principles.

Acceptance of Terms

By signing or otherwise approving Estimates from Wixfix, the Customer expressly accepts and agrees to be bound by all terms and conditions herein.

This Agreement can only be modified in a written document signed by both parties.

Wixfix reserves the ability to change or end any part of the service, such as available content, service hours, features offered, or equipment needed, without providing advance notice. This includes modifying the terms of this Agreement.

Acceptance of Terms and Authorization

By approving the provided estimate, the Client confirms acceptance and approval of the estimate details as well as any extra services, changed orders, or waived warranties involved with the work. In doing so, the Client acknowledges understanding the terms laid out in this Agreement and agrees to be bound by them.
